**交易行為說明**

4. 當我們向您發出郵件確認訂單發貨時,視為您的訂單已經被接受,而您與Cigarera之間的合同也已經成立;該合同將僅包括在發貨時所發出的確認郵件中載列的商品。因此,所有銷售合同均在香港特別行政區訂立。如因不可抗力或其他無法控制的原因致網站銷售系統無法正常使用,進而導致網上交易無法完成或丟失有關的資訊、記錄等,本網站將不承擔責任。但本網站將盡合理可能協助處理善後事宜,並努力使客戶減少可能遭受的經濟損失。

**發貨說明及時間**

網站自動物流系統以公平發貨原則安排網站訂單的發貨順序。若您帳戶內累計未完成訂單(如狀態為「處理中」的訂單)的系統發貨排程時間超過60個工作天(如受節假日或其他不可抗力因素影響,發貨排程將順延至下一個工作天,以實際排程時間為準),系統將未能為您創建新的訂單。您可以嘗試調整同一訂單內的商品數量,或待收到其他訂單商品(完成其他訂單)後再次購買。
**異動或取消訂單**
由於訂單在您付款完成後會立即進入自動化物流分配的流程,系統會在既定的時間內申請出口證,以利作備貨及出貨;因此,若作臨時的更改,可能造成訂單內容與出口證的紀錄有差異而影響自動化的安排。故此,如需異動或取消訂單,請於付款完成後的兩個小時內(以收到「[Cigarera] 訂單付款完成通知 (000XXXXXX)」郵件為準)聯繫本網站【線上客服】或登入會員帳戶;若逾時通知,恕我們未能取消或更改任何已進入自動化物流流程的訂單,感謝您的理解及體諒。
為了讓您享有更優質的購物體驗,我們建議您可先將心儀商品加入購物車或我的收藏,並於付款前先確認訂單詳情(包括商品數量、款式及價格等),以便我們更快捷妥當地將您精心選購的商品如期出貨給您。
取消訂單的手續費:我們將收取消訂單商品總價20%的手續費,即(取消總價 - 取消總價20%) = 實退金額。
實退金額請以實際支付為準,實際到帳日期,需以您付款銀行或網上付款平台處理週期(通常為八至十週)為準。
所訂購的商品一經取消,相關的優惠碼或優惠券不可再次使用。

套裝優惠或優惠折扣,若訂單取消後未達活動優惠或金額,保留商品將恢復原價計算,差額將從退款款項內扣除。
**通關檢查或稅款導致的退運**
自2023年6月12日起,每件退運貨品僅限重寄一次,退運所產生的任何費用將由會員自行承擔。您亦可以選擇在首次退運後安排退款。若貨品於重寄後再次退回,系統將自動根據以下退款細則安排退款而不另作通知。
我們在收到您的退件後會以「[Cigarera]退運郵包重寄安排」電郵通知,隨其附上重寄費的付款連結。如您選擇重寄貨品,請在十五個工作天內完成付款並回覆重寄相關信息,我們會依照您的回覆,以商品原盒的原包裹安排重新寄送。
*重寄費:您需支付第二次寄送的運費(US$35/郵包;US$70/兩個郵包;以此類推)。
如您選擇退款,請在十五個工作天內以電郵回覆(款項原路退回銀行帳戶)。收到您的回覆確認後,我們會在五個工作天內根據您的指示進行退款。系統將扣除首次郵寄費安排退款。
• 首次郵寄費為每個郵包USD 35,即 (退款貨品總價 - 首次郵寄費 = 實退金額);若貨品價值低於USD 35時,將扣除總價20%後退款 。
請注意:

3. 產品在退運及重寄的運輸途中,皆有機會被抽檢或會造成包裹及商品的損毀,然其狀況皆不在我們退換貨的服務範圍內。
4. 如因您未有及時清關及/或未有及時聯繫當地承運商進行通關導致產品退回,我們將收取US$50的二次倉儲 + 重寄費用 (US$35/郵包;US$70/兩個郵包;以此類推)。
5. 請務必核實填寫的收件人資料及訊息準確無誤,否則商品將可能因未能成功派遞導致退運。您可為退運商品重新支付郵寄費安排重寄(35美元/郵包;70美元/兩個郵包;以此類推),惟不論任何原因,每件退運商品僅限重寄一次。若貨品於重寄後再次退回,系統將自動根據退款細則安排退款而不另作通知。
您亦可於首次退運後選擇退款不再重寄,系統將扣除首次郵寄費後,自動安排退款。
• 首次郵寄費:35美元/郵包;70美元/兩個郵包;以此類推,即退款貨品總價 - 首次郵寄費 = 實退金額;若商品價值低於35美元,將扣除20%後退款。
**禁止及違規**
會員承諾絕不為任何非法目的或以任何非法方式使用服務條款,並承諾遵守香港特別行政區相關法規及一切使用網際網路之國際慣例。會員若係香港特別行政區以外之使用者,並同意遵守所屬國家或地區之法令。
會員同意並保證不得利用服務條款從事侵害他人權益或違法之行為,如發生下述情況,我們可以針對您的帳戶採取行動,這些情況包括但不限於:
• 您提交了若干材料(包括但不限於文字、圖像、音樂或視頻),但您並不具備充分的權利就該等材料授予上文「提交內容」一節中列明的許可。
• 使用多重帳戶或以任何方式干擾我們的服務。

Sales Platform
We may take action against your account under the following circumstances, including but not limited to:
All Cigarera products are sold exclusively on our independent sales platform, cigarera.org, and are not associated with any other cigar platforms.
If similar sales platforms, online customer service, or social media accounts are discovered, please exercise caution to avoid deception.
We will not recognize orders completed outside the aforementioned sales platform, nor provide any support or services. Any illegal acts causing harm to our reputation or property will be subject to legal liability and financial compensation.

Eligibility to Purchase

Transaction Guidelines
1. Members using the Terms for transactions must adhere to the product quantity and price confirmation mechanisms provided by the website.
2. Members agree that when placing orders via the Terms, Cigarera reserves the right to reject orders or cancel shipments until transaction confirmation is issued. After a member submits an order, the system will generate an acknowledgment, but this does not constitute order confirmation. Transaction validity is determined by shipment notification.
3. Members who arbitrarily return goods, cancel orders, or engage in any behavior deemed inappropriate by Cigarera, causing operational disruption or harm, may face refusal of service or permanent account termination.
4. When we send you a shipment confirmation email, your order is deemed accepted, and a contract between you and Cigarera is formed. This contract includes only the items listed in the shipment confirmation. Therefore, all sales contracts are established in the Hong Kong Special Administrative Region. We are not liable for transaction failures or data loss due to force majeure or uncontrollable factors affecting the website’s sales system. Combo products (e.g., world brand promotions) must be canceled in full; partial cancellations are not allowed.
If a main product is canceled but add-ons are retained, add-ons revert to original pricing.
Promotional sets or discounts: If retained items no longer qualify for promotions after cancellation, price differences will be deducted from refunds.
Returns Due to Customs or Taxes
Effective June 12, 2023, returned items may be resent once at the member’s expense. You may opt for a refund after the first return. If items are returned again after reshipment, refunds will follow the below rules automatically.
Upon receiving returned items, we will email “[Cigarera] Return Reshipment Arrangement” with a reshipment fee payment link. To resend, complete payment and reply with reshipment details within 15 business days. We will reship the original package.
Reshipment Fee: US$35 per package; US$70 for two packages, etc.
For refunds, reply via email within 15 business days (refunds processed to the original payment method). After confirmation, refunds will be issued within 5 business days, deducting the initial shipping fee.
• Initial Shipping Fee: USD 35 per package. Refund Amount = Total Item Value - Initial Shipping Fee. If item value < USD 35, a 20% deduction applies.

1. Failure to reply within 15 business days (from our first notification) will result in an automatic refund (Total Item Value - Initial Shipping Fee).
2. If items are returned again after reshipment, refunds will deduct the initial shipping fee automatically.
3. Products may be inspected or damaged during return/reshipment, which is not covered by our return policy.
4. If returns are due to delayed customs clearance or failure to contact local carriers, a US$50 restocking fee + reshipment fee (US$35 per package) applies.
5. Ensure accurate recipient details. Returned items due to failed delivery may be resent upon payment of reshipment fees (US$35 per package). Each returned item may only be resent once.

Prohibited Activities
Members agree not to use the Terms for illegal purposes or in unlawful ways and to comply with Hong Kong SAR laws and internet norms. Members outside Hong Kong must comply with their local laws.
Members must not engage in harmful or illegal activities via the Terms. We may take action against accounts for:
• Submitting materials (text, images, music, videos) without proper rights to grant licenses.
• Using multiple accounts or disrupting our services.
• Distributing illegal, harmful, threatening, abusive, harassing, defamatory, false, obscene, or racially offensive content.
• Sending unsolicited advertisements or messages.
• Impersonation or providing false information.
• Unauthorized commercial activities.
• Chain messaging.
• Any other behavior deemed inappropriate by Cigarera.
Cigarera reserves the right to terminate accounts at its sole discretion, with email notification.
Intellectual Property
All software and content (text, audio, video, graphics, photos) on Cigarera are our intellectual property, protected by laws and international treaties.
The website is for personal, non-commercial use. Content may not be copied, distributed, sold, or licensed without prior authorization. Unauthorized use may lead to legal consequences. We reserve the right to modify or withdraw services without notice. We are not liable for website unavailability.
Third-Party Links
Links to external sites not operated by us are beyond our control. We are not responsible for their content, accuracy, or any loss arising from their use. Users assume all risks when accessing third-party sites.
